Why Idaho is different

The Idaho Transportation Department, citing Idaho Code §49-123(2)(o), treats a vehicle as salvage when it already has a salvage certificate or similar document, when its owner or insurer finds it uneconomical to repair or rebuild, or when an insurer has paid it out as a total loss. There is no fixed percentage: the test looks at the cost of parts and labor and the vehicle’s salvage value. A salvage vehicle cannot be registered until a title application has been submitted.

When a salvage certificate is surrendered with a title application, ITD issues a title branded "Rebuilt Salvage", and the department states that brand stays on the title for the life of the vehicle. A comparable brand on an out-of-state title is carried forward when the car is titled in Idaho. A stolen vehicle that is recovered without being salvage gets the notation "Theft Recovery" on its next title instead.

Idaho leans on penalties to keep sellers honest. An owner who keeps a totaled vehicle and fails to surrender the title, or sells it without disclosing that it was totaled, commits a misdemeanor under §49-524(8). Insurers must report owner-retained payoffs to ITD within 30 days. Buyers should still read the title brand, ask directly about insurance claims and check total-loss and auction records.

Title brands in Idaho

Salvage certificate
The ownership document for a salvage vehicle before it is retitled. A vehicle in this status cannot be registered until a title application is submitted.
Rebuilt Salvage
Applied when a salvage certificate is surrendered with a title application. ITD states that the brand remains on the title for the life of the vehicle.
Theft Recovery
Noted on the next title of a stolen vehicle that was recovered but is not a salvage vehicle.
Out-of-state comparable brand
When a vehicle with a comparable brand on an out-of-state title is titled in Idaho, that brand is carried forward.

Red flags specific to Idaho

⚠ Owner-retained total loss
An owner can keep a car after an insurer payoff. Idaho requires the insurer to report that to ITD within 30 days, and an owner who fails to surrender the title commits a misdemeanor; a seller with a regular title and an admitted insurance payout needs a closer look.
⚠ "Theft Recovery" is not a damage-free guarantee
The notation marks a recovered stolen car that did not qualify as salvage. Damage below the salvage level, missing parts or replaced components can still exist, so inspect the vehicle and its records.
⚠ Out-of-state title from another jurisdiction
Idaho requires a VIN Inspection Certification (ITD 3403) only when the ownership document comes from another jurisdiction. Compare the out-of-state title’s brands with what appears on the Idaho title.
⚠ Judgment-based salvage test
Because Idaho uses an "uneconomical to repair" test rather than a set percentage, damage history can sit in insurer and auction records without a brand on the title.

Frequently asked questions

Under Idaho Code §49-123(2)(o), as described by ITD, it is a vehicle with a salvage certificate or similar documentation, one the owner or insurer finds uneconomical to repair or rebuild, or one an insurer has paid as a total loss.

No. ITD states that the "Rebuilt Salvage" brand will remain on the title for the life of the vehicle.

It is a notation on the next title of a vehicle that was stolen and recovered but is not a salvage vehicle.

Yes. Under Idaho Code §49-524(8), an owner who keeps a totaled vehicle and fails to surrender the title, or sells it without disclosing that it was totaled, commits a misdemeanor punishable by up to six months in jail, a fine of up to $1,000, or both.

For salvage vehicles, ITD lists the VIN Inspection Certification (ITD 3403) as required only when the ownership document was issued by a jurisdiction other than Idaho.

It may. CARFAX and AutoCheck reports, and Copart or IAAI auction records with photos, can include total-loss and salvage-sale events, but no source contains every record, and a report without them does not prove a clean history.
